FGC Fishing Charters

Liability Waiver, Release & Assumption of Risk

This Liability Waiver and Release (“Agreement”) is entered into by each undersigned passenger (“Participant”) in favor of FGC Fishing Charters (“Charter Operator”).

All trips are private fishing charters operating from Bradenton, Florida, in the Gulf of America. This Agreement shall be governed by Florida law and applicable federal maritime law.

ASSUMPTION OF RISK

Participant understands and acknowledges that boating and fishing activities involve inherent and unpredictable risks, including but not limited to: rough seas, changing weather conditions, vessel movement, slips and falls, equipment or mechanical failure, fishing hooks and gear, wildlife interactions, and the risk of serious injury or drowning.

Participant voluntarily assumes all risks, known and unknown, associated with participation in the charter.

RELEASE OF LIABILITY

Participant hereby releases, waives, and discharges FGC Fishing Charters, its owners, captains, crew members, employees, agents, and insurers from any and all claims, demands, causes of action, or liability arising out of or related to participation in the charter, including claims based on negligence, to the fullest extent permitted by Florida law and federal maritime law.

Participant agrees not to sue or bring any claim against the Charter Operator for any injury, loss, or damage arising from participation.

MEDICAL & FITNESS ACKNOWLEDGMENT

Participant certifies that they are physically capable of participating in boating and fishing activities, can swim or float, and have no medical condition that would prevent safe participation. Participant agrees to comply with all safety instructions provided by the captain and crew.

MINORS

Participants under the age of eighteen (18) must have this Agreement executed by a parent or legal guardian. The parent or legal guardian assumes full responsibility for the minor participant and agrees to all terms of this Agreement on the minor’s behalf.
